 1. Introduction
1.1. Brisbane paediatric Nurse provides baby and child health and parenting solutions by in home assessments, and telephone follow up.
1.2. These Terms and Conditions (Terms and Conditions) govern all services provided by Brisbane paediatric Nurse and apply to all transactions via the Brisbane paediatric Nurse website, www.brisbanepaediatricnurse.com.au, (Website) and use of the Website.
1.3. If any statement on the Website is inconsistent with these Terms and Conditions, these Terms and Conditions shall prevail.

2. Website Terms and Conditions
2.1. The information provided on the Website is general information about Brisbane paediatric Nurse and the services provided. It’s accuracy and completeness are not guaranteed, and the content is subject to change. It does not constitute advice to you and must not be relied upon for any purpose.
2.2. To the maximum extent permitted by law, all liability for any loss or damage of any kind arising out of or in connection with your use of the Website or its content is excluded.
2.3. The content of the Website is subject to copyright and other intellectual property laws and must not be reproduced without the written consent of Brisbane paediatric Nurse.
2.4. Links or reference to other third party websites provided on the Website are outside the control of Brisbane paediatric Nurse and it does not endorse those websites nor take any responsibility whatsoever for any of their content.
2.5. You take full responsibility for any information or payments received or sent electronically through this Website. Brisbane paediatric Nurse does not warrant that payments are secure and hereby excludes all liability for any loss arising due to cyber crime or failure of computer systems.

3. Services
3.1. Brisbane paediatric Nurse will provide the services set out on the Website and agreed between you and Brisbane paediatric Nurse (Services).
3.2. The Services shall be provided by appointment, consultation, or otherwise, as required, at either at your home or at an agreed alternative address.
3.3. All Services are provided in accordance with the requirements of the Nurses and Midwifery Board of Queensland and the Australian Health Practitioner Regulation Agency and their standards and codes of conduct.

3.4 Brisbane paediatric Nurse, will not provide any service or advice within a midwifery capacity, and will only see babies from 2 weeks of age onwards.

4. Appointments
4.1. The Services are provided as set out on the Website and require pre-booking for a specific date and time (Appointment).
4.2. Appointments must be booked through the Website and paid in full prior to Services delivery.
4.3. Brisbane paediatric Nurse is under no obligation to offer an Appointment, or subsequent Appointments, and reserves the right to cancel an Appointment at any time.
4.4. Appointment times, duration, and details of the Services to be provided and fees payable shall be provided as set out by Brisbane paediatric Nurse in its absolute discretion.
4.5. The fee for each Service fee are as stated on the Website, are subject to change and are accepted by you by making a booking for an Appointment.

 

5. Payments and Refunds Policy
5.1. Payment for each Service, is due in full at the time of booking. Any additional fees payable at the time of the Services delivery as a result of additional time are immediately due and payable.
5.2. If you cancel an Appointment with less than 7 days notice you will be entitled to a 50% refund of the fees. If you cancel with less than 48 hours notice then no refund will be given.

6. Limitation of Liability
6.1. The accuracy and effectiveness of the Services provided is dependent on your full disclosure of all relevant facts relating to your child, and your answering all questions asked as fully as possible.
6.2. A failure to fully disclose any information requested by Brisbane paediatric Nurse, or any factor of which you should have made us aware, may affect the accuracy or efficacy of the Services and Brisbane paediatric Nurse accepts no responsibility in that regard.
6.3. All Services provided are in line with current established guidance recommended by health professionals in Australia. Any advice given, even if implemented correctly, may not affect or result in any improvement in your child’s sleep or prevent Sudden Infant Death
Syndrome (SIDS).
6.4. SIDS is a condition which is still not fully understood and can occur unexpectedly, even when SIDS guidelines are followed. No liability is accepted for any death or harm occurring to your child during or after the Appointment or from you adhering to the advice provided.
6.5. Brisbane paediatric Nurse cannot carry out a medical assessment of your child. If you suspect that your child is ill you should contact your doctor immediately.

7. Privacy Policy
7.1. Brisbane paediatric Nurse complies with all applicable legislation and regulations with respect to your privacy.
7.2. All personal information (including but not limited to name, telephone number, address, e-mail address, date of birth etc) (Personal Information) that you provide will be used by Brisbane paediatric Nurse only in connection with providing services to you.
7.3. Personal Information may be disclosed to other organisations which contract with Brisbane paediatric Nurse, who will be bound by these Terms and Conditions, in connection with providing services to you.
7.4. Personal Information will not be disclosed to any third party without your consent unless required to do so by law.

8. Governing Law
8.1. These Terms and Conditions are governed by and construed in accordance with the law of the State of Queensland.

 You submit to  the jurisdiction of the courts of Queensland in relation to any dispute arising from these Terms and Conditions

  or the provision of  Services to you. Brisbane paediatric nurse are covered by professional indemnity and public liability insurance.
